The Public Meeting and Public Hearing dates for the Municipal Settings Designation for the American Plant Food site, have been changed. The new dates are: Public Meeting will be held January 4, 2017 at 5: 30 pm in Nacogdoches City Council Chambers, 202 E. Pilar Street, Nacogdoches, Texas City Council Members may attend the Public Meeting in numbers which constitute a quorum. The Public Meeting is an educational meeting where there will be no deliberation by City Council, nor will there be any formal action taken by City Council. Public Hearing will be held January 16, 2017 at 5: 30 pm in Nacogdoches City Council Chambers, 202 E. Pilar Street, Nacogdoches, Texas American Plant Food Corporation and surrounding properties (Applicant) is filing an application with the Texas Commission on Environmental Quality ( TCEQ) for certification of a Municipal Setting Designation ( MSD) pursuant to Texas Health and Safety Code, Chapter 361, Subchapter W. The requested MSD is for three adjacent properties located on the north side of Bennett Clark Road, Nacogdoches, Texas ( Site). The properties are identified as Lots 8, 8- C, 8- D, 8- E, 9, and 9- A, Block 59 in the J. T. Shanks Survey. A copy of the application filed with the City of Nacogdoches is available for public viewing at the Nacogdoches Public Library, 1112 North Street, Nacogdoches. The shallow groundwater at the Site has been impacted by nitrate from historical releases possibly associated with fertilizer blending operations. The exact time and circumstances surrounding the release of contaminants are unknown. The purpose of an MSD is to create a means by which the TCEQ may limit the scope of investigations and response actions for groundwater contamination at a site, if the groundwater beneath the site is prohibited for use as a potable water source by ordinance or restrictive covenant.
